Terms of Service

1. Agreement

By accessing or using SwapAd (“Service”), you agree to be bound by these Terms. The Service is provided by Noviantis Inc(“we”, “us”), a Florida corporation. If you disagree with any part, do not use the Service.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract.

3. Account & security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at security@swapad.app of any unauthorized use.

4. Subscription & billing

  • Paid plans (Pro, Agency) auto-renew monthly unless canceled
  • You may cancel at any time via Settings → Billing
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial months; see our Refund Policy

5. Acceptable use

You agree NOT to use the Service to:

  • Generate content that is illegal, harassing, or deceptive
  • Infringe third-party intellectual property rights
  • Generate adult, violent, or hateful content
  • Impersonate others or misrepresent yourself
  • Attempt to reverse-engineer, scrape, or circumvent rate limits

Violations may result in immediate account termination without refund.

6. User content & IP

You retain ownership of images and text you upload. You grant us a limited, non-exclusive license to process your content for the sole purpose of providing the Service. You are solely responsible for having the rights to any content you upload.

Generated images are yours to use commercially, subject to the terms of the underlying AI providers.

7. Disclaimer

The Service uses third-party AI models. Output quality may vary. We do not guarantee that generated images will be free of errors, biases, or unintended artifacts. You are responsible for reviewing all output before publishing.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NOVIANTIS INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE PREVIOUS 12 MONTHS.

9. Governing law

These Terms are governed by the laws of the State of Florida, USA. Any dispute shall be resolved in the courts of Miami-Dade County.

10. Changes

We may update these Terms. Material changes will be notified by email. Continued use after changes constitutes acceptance.
